Monica Whitten is a business attorney and commercial litigator representing companies, investors, and principals in complex commercial disputes and risk‑sensitive business matters. Her practice focuses primarily on disputes and risk arising from mergers and acquisitions, corporate finance transactions, commercial real estate, lender enforcement actions, federal tax controversy, and sophisticated contract matters.

Monica regularly represents clients in state and federal courts and advises businesses throughout all phases of commercial dispute resolution, including early case assessment, pre‑litigation strategy, pleadings and motion practice, discovery, alternative dispute resolution, settlement negotiations, and trial. She handles post‑transaction litigation, commercial lease disputes, creditor and lender remedies, and contract enforcement matters, with a focus on preserving leverage and managing risk in a manner consistent with clients’ operational and financial objectives. Her practice also includes advising clients in an outside counsel capacity on corporate governance, contract negotiation, and risk management, providing strategic guidance and litigation oversight to support informed decision‑making.

Prior to joining Gutnicki LLP, Monica served as a law clerk in Chicago‑Kent College of Law’s Tax Practice, where she focused on federal tax controversy, foreign asset compliance, and tax‑exempt organizations. That experience provided a strong foundation in financial issues that frequently intersect with commercial litigation.

Before becoming an attorney, Monica spent fifteen years in portfolio management and corporate finance within the commercial real estate and pension fund advisory sectors, working closely with lenders and investors. She draws on that background to provide practical, business‑focused counsel in both litigation and advisory matters.
